Proposition 3 – SJR 5 – Explained in ASL
“The constitutional amendment requiring the denial of bail under certain circumstances to persons accused of certain offenses punishable as a felony.”
Visual Description: A man is seated at a wooden table against a plain off-white background. He has light brown skin, a bald head, and a neatly trimmed beard. He is wearing clear-framed glasses, a black short-sleeve shirt, and a black smartwatch on his left wrist.
Context: When a person is charged with a crime, it can stay out of jail by the use of bail. If they don’t have a bail, they will have to wait in jail until trail. This proposition asks voters to allow judges to deny bail to people accused of very serious crimes such as murder, aggravated sexual assault, aggravated robbery, kidnapping, or human trafficking if prosecutors show the person is a danger or might not return to court. Judges must explain in writing if they decide to grant bail in those cases. Votes yes means bail must be denied in these serious cases when the prosecutor shows danger or risk of escape. Votes no means judges keep more freedom to allow bail even in those cases.
